Terms of Service

These terms govern your use of Thozha. They are written to be read once and understood. Where the legal language is unavoidable, we keep it short.

1. Agreement

By creating an account or using Thozha (“the Service”) you agree to these terms with Thozha Education Pvt. Ltd. (“Thozha”, “we”, “us”). If you do not agree, you may not use the Service.

The Service is available on the web, via the Google Play Store (Android), and the Apple App Store (iOS). Your use of the Service is also subject to the terms and policies of the platform through which you access it (Google Play Terms of Service or Apple Media Services Terms and Conditions, as applicable). In the event of a conflict between these terms and the platform terms, the platform terms shall prevail with respect to platform-specific matters (e.g. billing, refunds processed by the platform).

2. Eligibility

You must be at least 16 years old. If you use the Service on behalf of a coaching institute or organisation, you confirm you have authority to bind that organisation.

3. Your account

  • You are responsible for safeguarding your credentials. We recommend a unique password and 2FA where available.
  • You agree to provide accurate registration information and to keep it updated.
  • One account per person. Sharing accounts is a breach of these terms.
  • You are responsible for all activity that occurs under your account. Notify us immediately at support@thozha.in if you suspect unauthorised access.

4. Subscriptions & billing

The Free tier is available to all eligible users at no cost. SUPER is a paid subscription with the prices shown on /pricing. Subscriptions auto-renew at the end of each billing cycle (monthly or yearly) until you cancel.

4.1 Platform billing

If you subscribe through the Apple App Store, payment is processed by Apple. If you subscribe through Google Play, payment is processed by Google. In both cases:

  • Your subscription will automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current billing period.
  • Your platform account (Apple ID or Google account) will be charged for renewal within 24 hours prior to the end of the current period at the subscription price displayed at the time of purchase.
  • You can manage and cancel subscriptions through your device settings: iOS → Settings → [Your Name] → Subscriptions; Android → Google Play Store → Subscriptions.

4.2 Web billing

If you subscribe via the web, payment is processed by Razorpay. You can cancel any time from your profile. Cancellation takes effect at the end of the current billing period.

We may change prices with 30 days' notice. Renewals after the notice are at the new price. Price changes for platform subscriptions (iOS/Android) are subject to the respective platform's policies.

5. Refunds

7-day refund window. If you cancel SUPER within 7 days of your first charge (via web/Razorpay), we refund the full amount. After 7 days, refunds are at our discretion and pro-rated to unused time. Refunds are returned to the original payment method within 7–10 business days.

Platform purchases: If you subscribed through Google Play or the Apple App Store, refund requests must be directed to the respective platform, as they control the billing relationship. Visit Google Play Refunds or Apple Refunds for details.

We do not offer refunds for accounts terminated for breach of these terms.

6. Acceptable use

You will not:

  • Reverse-engineer, scrape, or automate the Service except via official APIs.
  • Resell, sublicense, or repackage Thozha content (lessons, MCQs, evaluation output).
  • Upload content that is unlawful, infringes IP, or is intended to harm the Service or other users.
  • Use Thozha to commit academic fraud, including submitting AI-generated answers as your own work in exams.
  • Attempt to bypass usage caps on the Free tier.
  • Harass, bully, impersonate, or threaten other users of the Service.
  • Distribute malware, spam, or any content that could damage or interfere with the Service.

Reporting abuse: If you encounter content or behaviour that violates these terms, you can report it via the in-app report button, or by emailing support@thozha.in. We will investigate and take appropriate action, including removing content and suspending accounts.

7. Your content & licence

You retain ownership of everything you upload (Mains answers, notes, doubt queries “Your Content”). To operate the Service you grant Thozha a non-exclusive, worldwide, royalty-free licence to host, store, and process Your Content solely to deliver the Service to you.

We do not use Your Content to train third-party models. See our privacy policy.

You represent and warrant that you have the right to upload Your Content and that it does not infringe any third-party rights. We reserve the right to remove content that violates these terms or applicable law.

8. Our intellectual property

Lesson content, MCQ databases, evaluation rubrics, the software, and all trademarks (including the name “Thozha” and the wordmark) are owned by Thozha or its licensors. We grant you a personal, non-transferable licence to use the Service for individual exam preparation only.

9. AI disclaimer

Thozha uses AI for evaluation, doubt resolution, and content summarisation. AI output may contain errors. We provide source citations so you can verify — please do.

Thozha's AI feedback is a study aid. It is not a substitute for a qualified mentor or examiner, and we make no guarantee of exam outcome.

AI-generated content (evaluations, summaries, chat responses) is generated specifically for you based on your inputs. You may use AI outputs for your personal study purposes. We do not claim ownership of AI-generated outputs delivered to you, but they may not be redistributed or used commercially.

10. No warranty

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Liability cap

To the maximum extent permitted by law, Thozha's total liability arising out of or related to the Service in any twelve-month period shall not exceed the greater of (a) the amount you paid us in that period or (b) ₹2,000.

We are not liable for indirect, incidental, consequential, or punitive damages, including loss of marks, lost opportunity, or loss of data beyond what is recoverable from our backups.

12. Termination & account deletion

You may terminate by closing your account. We may suspend or terminate accounts that breach these terms, with notice except where the breach is severe or legal compulsion requires otherwise.

On termination, your access to paid features ends and your study data is deleted within 30 days, unless we are required to retain it by law.

12.1 Account deletion

You have the right to delete your account and all associated data at any time. You can do this through:

Upon deletion, all personal and study data will be permanently removed within 30 days. Tax and payment records are retained for 8 years per Indian tax law. If you have an active platform subscription (Google Play or App Store), you must cancel it separately through the platform to stop future charges.

13. Governing law & disputes

These terms are governed by the laws of India. Any dispute will be submitted to the exclusive jurisdiction of the courts at Chennai, Tamil Nadu, except where consumer protection law provides otherwise.

Before filing any formal proceeding, you agree to attempt to resolve the dispute informally by contacting us at legal@thozha.in. We will attempt to resolve the dispute within 30 days.

14. Changes

We may amend these terms as the product evolves. Material changes will be notified by email and a banner in the app at least 14 days before they take effect. Continued use after a change constitutes acceptance. The effective date at the top of this page will be updated accordingly.

15. Export compliance

The Service may be subject to United States export laws and regulations. You agree that you will not use, export, or re-export the Service in violation of any applicable export laws, including the US Export Administration Regulations (EAR). The Service uses standard, commercially available encryption (TLS/HTTPS, AES-256) for data protection and does not include proprietary cryptographic technology.

By using the Service, you represent and warrant that (a) you are not located in a country subject to US Government embargo, and (b) you are not listed on any US Government list of prohibited or restricted parties.
